Psychiatric examinations for the purpose of Road Traffic Inspectorate

Psychiatric examination for purposes of the Road Traffic Inspectorate of the Police Corps to confirm or to rule out alcohol addiction of the offender is unique in relation to a particular offense. Its conclusion should have the weight of evidence if needed. It should be carried out in required term. Re-examination of the same case in time lapse by another psychiatrist with the intention of avoiding the addiction diagnosis and its associated legal consequences should fulfill the criteria of committing a fraud. Before the examination, psychiatrist should ask the offender for signed confirmation that this assessment is genuine, not elsewhere repeated, providing only true history data, and that its conclusions will respected by the client (who will be taken for responsibility in case of violation). The doctor must keep copies of all relevant required information (medical records, laboratory results, psychiatric examination itself, examination order signed by the client, the decree to review the health capacity, any related issued receipts and others). Currently there is no law that would protect the psychiatrist’s rights; however their clear answer is always required.
